Under the California Labor Code §§ 3200–6002, most employers are required to carry workers' compensation insurance, and injured employees are entitled to benefits from the first day of employment.

What You're Entitled To
Workers' Compensation Benefits in California
California workers' compensation law provides five categories of benefits to injured employees.
Medical Treatment
All reasonable and necessary medical care to treat your work injury, including doctors, surgeons, hospitals, physical therapy, medications, and diagnostic tests, paid for by your employer's insurance.
Temporary Disability
If your injury prevents you from working, you receive two-thirds of your average weekly wage (up to the state maximum) while you recover. Payments begin after 3 days of missed work.
Permanent Disability
If your injury results in a permanent impairment, you may receive ongoing weekly payments based on your disability rating, age, occupation, and wages under Labor Code § 4660.
Supplemental Job Displacement
If you can't return to your prior job and your employer doesn't offer modified work, you may receive a voucher of up to $6,000 for retraining or skill enhancement.
Death Benefits
When a work injury causes death, surviving spouses, children, and other dependents are entitled to weekly death benefits and a burial expense allowance under Labor Code § 4700.
Return to Work
California law requires employers to provide modified or alternative work to injured employees where feasible. We ensure your employer meets this obligation or that you receive proper compensation.

Psychological Injuries
California workers' comp covers psychiatric injuries, including PTSD, anxiety, and depression, caused by workplace events or cumulative stress under Labor Code § 3208.3.

Notify your employer of your injury in writing as soon as possible, California law requires you to report within 30 days. Your employer must provide a Workers' Comp Claim Form (DWC-1) within one working day.
